RECOMMENDATION(S):

1. APPROVE a Sublease Termination Agreement with the YMCA of the East Bay effective November 30, 2010, for the approximately 1,440 square foot County-owned modular building at 470 Parker Avenue, Rodeo, under the terms and conditions set forth in the Sublease Termination Agreement.   
  

2. AUTHORIZE the Deputy Director of General Services, or designee, to EXECUTE the Sublease Termination Agreement.

3. DETERMINE the project is a Class 1(a) Section 15301 Categorical Exemption under the California Environmental Quality Act (CEQA).  
  
4. DIRECT the Department of Conservation and Development Director, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Deputy Director of General Services, or designee, to arrange for the payment of the handling fees to the Department of Conservation and Development and County Clerk for filing of the Notice of Exemption.  
  

FISCAL IMPACT:

The YMCA has vacated the premises. The County will not receive the monthly revenue of $500, until a new tenant is found for the modular.

BACKGROUND:

The John Swett Unified School District owns the multi-acre parcel of land known as the Lefty Gomez Ballfield in Rodeo, and most of the improvements on that land. The County has leased the land from the School District, which lease expires in 2045. The subleased land and buildings are managed by the Public Works Department - Special Districts Division as part of Special District County Service Area (CSA) R-10.   
  
The County previously subleased a portion of the land known as 470 Parker Avenue to the YMCA of the East Bay. That sublease is for a term that expires in 2013. As provided in that sublease, the YMCA built an approximately 1,440 square foot modular building for classroom and other youth-oriented activities. Title to the modular building transferred to the County upon the completion of the modular's construction as provided in the sublease.   
  
The School District requested that the YMCA occupy one of the School District's properties at another location. The YMCA subsequently vacated the County's modular building, and has asked the County to terminate its sublease. The YMCA completed several repairs to the modular as requested by the County. Those repairs included new carpet and repair to the linoleum in portions of the modular, repair of the ramp leading to the modular, and repairs to the HVAC and exterior stucco.  
  
Subsequent to the YMCA vacating the modular building, County negotiated the terms of a new sublease with the Contra Costa County Office of Education (CCCOE) to occupy the modular building for classroom and youth-oriented activities. The CCCOE has reported that it has found another location for its operations, and has decided not to sublease the County's modular. The modular is now vacant, and County staff will attempt to find a new occupant.

CONSEQUENCE OF NEGATIVE ACTION:

The revenue lease with the YMCA of the East Bay will not be terminated.
