RECOMMENDATION(S):

RECEIVE this report concerning the final settlement of Raymond V. Gee vs. County of Contra Costa and AUTHORIZE payment from the Medical Liability Internal Service Fund in the amount of $225,000. The County has also agreed to pay for medical treatment to correct strictures related to the original surgery if necessary.

FISCAL IMPACT:

Medical Malpractice Internal Service Fund payment of $225,000 and future surgical cost if necessary

BACKGROUND:

Attorney W. David Walker, defense counsel for the county, has advised the County Administrator that within authorization an agreement has been reached settling the medical malpratice claim of Raymond v. Gee v. Contra Costa County.

The Board's January 13, 2009 closed session vote was Supervisors Gioia, Piepho, Bonilla, Glover and Uilkema - Yes.

BACKGROUND: (CONT'D)

This action is taken so that terms of this final settlement and the earlier January 13, 2009 closed session vote of this Board authorizing its negotiated settlement are known publicly.
