RECOMMENDATION(S):

APPROVE the Alhambra Valley Road Pedestrian Bridge project contingency fund increase of $10,000.00 for a new contingency fund amount of $30,140.92 effective February 3, 2009, and APPROVE and AUTHORIZE the Public Works Director, or designee, to execute Contract Change Order No. 2 with E.E. Gilbert Construction, Inc., effective February 3, 2009, in an amount not to exceed $20,000.00, to a new payment limit of $231,550.09 for increased cost of drilled piers and concrete bridge abutments, Martinez area. (Alhambra Valley Specific Plan funds)(District II) Project No. 0662-6R4059-08.

FISCAL IMPACT:

The project contingency funds are currently insufficient to cover the increased cost. The increase in contingency funds will be funded by Alhambra Valley Specific Plan funds.

BACKGROUND:

Additional funding is required to increase the contract contingency amount to pay the contractor for additional costs incurred during the construction of the pedestrian bridge drilled piers and concrete bridge abutments. Approval of the contingency fund increase is required to compensate the contractor for the additional work.



CONSEQUENCE OF NEGATIVE ACTION:

The lack of approval would prevent successful completion of this contract and preclude payment to the contractor for the required work.
