RECOMMENDATION(S):

APPROVE and AUTHORIZE the Purchasing Agent to execute, on behalf of the Health Services Director, a change order with Software One, Inc., to increase the payment limit by $599,480 from $6,700,000 to a new payment limit of $7,299,480, to add the vaccine verification software to its Microsoft Suite with no change in the term of January 1, 2021, through December 31, 2021.  

FISCAL IMPACT:

Approval of this purchase order will result in an expenditure of up to $7,299,480 as budgeted by the department in FY 2021-22. The total cost of the amendment ($599,480) will be fully funded by the American Rescue Plan Act or FEMA.









BACKGROUND:

The Health Services Department (HSD) seeks to acquire Microsoft's Return to Work (RTW) software solution from Microsoft’s authorized third-party reseller Software One, Inc. The software includes a centralized database which will enable HSD to manage the COVID-19 vaccination status of its employees. HSD licensed Microsoft Office 365 products (including Outlook, Excel, Word) and technical support through Microsoft’s authorized third-party reseller, Software One, Inc., and enrolled in an Enterprise Agreement and Server and Cloud Enrollment Agreement for the licensing of Microsoft applications. Additional temporary licenses are needed for COVID-19 monitoring. HSD will terminate the additional licenses when no longer needed. The County will benefit from discount volume pricing negotiated for all California counties.

CONSEQUENCE OF NEGATIVE ACTION:

The failure to acquire the Microsoft Return to Work (RTW) solution will render HSD unable to view and track the COVID-19 vaccination status and ongoing testing certification for approximately 5,200 employees, thus preventing HSD from meeting State and County guidelines.
