RECOMMENDATION(S):

APPROVE and AUTHORIZE the Auditor-Controller, or designee, to pay $106,063.96 to Nazar Mohammad Aryaei (dba AA Cab Company), an individual, for non-medical transport services for Contra Costa Health Plan (CCHP) members provided in good faith during the period May 1, 2021 through September 30, 2021.

FISCAL IMPACT:

This retroactive payment in the amount of $106,063.96 is funded 100% by Hospital Enterprise Fund I revenues.

BACKGROUND:

CCHP has been contracting with Nazar Mohammad Aryaei (dba AA Cab Company), since October 2016 to provide non-medical transport services for CCHP members.

In October 2020, County Administrator approved and Purchasing Services Manager executed Contract #77-040-6 with Nazar Mohammad Aryaei (dba AA Cab Company), in an amount no to exceed $100,000 to provide non-medical transport services for CCHP members, for the period October 1, 2020 through September 30, 2021.   
  
Due to a much higher than anticipated number of requests for non-medical transport services during the COVID-19 pandemic and an administrative overisght of the contract's utilization, the contract payment of the expired contract is insuffient to pay for the additional services provided. The contractor continued to provide these services in good faith during the period May 1, 2021 through September 30, 2021, which exceeded the payment limit by $106,063.96.  
  
Therefore, the County has determined that Nazar Mohammad Aryaei (dba AA Cab Company), is entitled to payment for the reasonable value of their services under the equitable relief theory of quantum meruit. That theory provides that where a person has been asked to provide services without a valid contract, and the provider does so to the benefit of the recipient, the provider is entitled to recover the reasonable value of those services.

CONSEQUENCE OF NEGATIVE ACTION:

If this request is not approved, the contractor will not be paid for services provided to CCHP members rendered in good faith.
