RECOMMENDATION(S):

ADOPT Resolution No. 2021/396 supporting a grant application to the Sacramento–San Joaquin Delta Conservancy (Delta Conservancy), Proposition 1 Ecosystem Restoration and Water Quality Grant Program (Proposition 1 Grant Program) for planning of the Marsh Creek Reservoir Restoration and Total Mercury Reduction Project (Project), and authorizing and directing the Chief Engineer, Contra Costa County Flood Control and Water Conservation District (Flood Control District), or designee, to submit the application on behalf of the Flood Control District in the amount of $350,000, Brentwood area.

FISCAL IMPACT:

The grant amount requested from the Delta Conservancy will be $350,000 (58% of the Project cost). The Flood Control District would contribute $249,898 (42%) from Flood Control Zone 1 Funds towards the Project. (Project No. 7521-6D8495)









BACKGROUND:

The Flood Control District owns and manages the Marsh Creek Reservoir, which was created in 1962 by constructing a dam over Marsh Creek. The Marsh Creek Reservoir significantly reduces flood risk to the downstream communities of Brentwood and Oakley. The Marsh Creek Reservoir is surrounded by seasonal wetland and wildlife habitat. The Flood Control District is developing a multi-objective plan to enhance the Marsh Creek watershed ecosystem, increase its resilience to climate change, extend the reservoir’s useful life, manage mercury-laden sedimentation, improve the quality of life for Delta residents, and increase recreational opportunities in the Delta Region.  
  
In response to a call from the Delta Conservancy, the Flood Control District submitted a concept proposal in August 2021with the intent to apply for funds from the Proposition 1 Grant Program. Known as Proposition 1, the Water Quality, Supply and Infrastructure Improvement Act of 2014 was approved by California voters in November 2014. The Proposition 1 Grant Program allocates funds to the Delta Conservancy for competitive grants for multi-benefit ecosystem and watershed protection and restoration projects in accordance with statewide priorities.  
  
If selected for funding, this grant will become effective next summer. The Flood Control District will fund its $249,898 share out of Flood Control Zone 1 ad valorem tax revenue during the next budget cycle.

CONSEQUENCE OF NEGATIVE ACTION:

Without the Board of Supervisors’ approval, the Flood Control District will not be able to apply for the Delta Conservancy Proposition 1 Grant Program. A supporting resolution is required to submit the grant application.
