RECOMMENDATION(S):

Acting as the governing body of the Contra Costa County Flood Control and Water Conservation District (Flood Control District), ADOPT the Flood Control Capital Improvement Plan (Plan) for fiscal years 2021/22 to 2027/28, as recommended by the Transportation, Water and Infrastructure Committee (TWIC), Countywide.

FISCAL IMPACT:

The Plan is a multi-year programmatic, planning-level document that outlines capital expenditures for the Flood Control District. All expenditures identified in the Plan are planned to be funded through various flood control funds and other local, state, or federal grants with no impact to other County funds.

BACKGROUND:

The Plan is a programming document for the funding of capital projects within the Flood Control District that covers seven fiscal years. The Plan is prepared under the guidance of the Flood Control District Expenditure Policy and is intended to inform the public and community stakeholders about flood control projects and provide direction to staff for project planning and staffing.

The Plan is intended to be a living document updated every two years or as needed. As more information is gathered about each project, the Flood Control District may determine that some projects will need further revisions in scope, cost, and/or schedule. In such cases, the Flood Control District will revise subsequent plans to reflect those changes.  
  
The Plan was presented as a draft document to the TWIC on September 13, 2021. The TWIC accepted the Plan, opened a public review period, and scheduled a public meeting to receive and consider public comments. A public meeting was held by the TWIC on November 8, 2021. At the public meeting, staff presented a summary of the comments received during the public review period. None of the comments required any changes to the draft Plan. The TWIC accepted the Plan as presented and recommended that the Board of Supervisors adopt the Plan.  
  
In summary, the Plan recommends 29 projects within the Flood Control District representing an investment of approximately $56 million over a 7-year period. Approximately $39 million of this investment is planned to be directly funded through various flood control funds, and $13 million is currently planned to come from other local, state, or federal grants. The remaining portion of this investment is currently unfunded, but as projects are further developed, additional funds are expected to be sought and received.  
  
Adoption of the Plan by the Board of Supervisors does not automatically approve capital projects listed in the Plan. Capital projects are subject to separate public review, engineering feasibility analysis, environmental assessment, and final approval by the Board of Supervisors.

CONSEQUENCE OF NEGATIVE ACTION:

Without this approval, the Flood Control District cannot adopt its Plan in compliance with the 2005 Flood Control District Expenditure Policy.
