RECOMMENDATION(S):

APPROVE and AUTHORIZE the District Attorney, or designee, to execute on behalf of the County a contract with RYSE Center, in an amount not to exceed $900,001, to provide a Restorative Justice Diversion R.E.S.T.O.R Program designed to reduce racial and ethnic disparities between youths of color and white youths entering the juvenile justice system by providing eligible youth offenders of color and victims wraparound services, for the period July 1, 2019 through February 28, 2023.

FISCAL IMPACT:

This contract is funded 100% by State funding.

BACKGROUND:

On July 9, 2019, the Board of Supervisors adopted Resolution 2019/491 approving and authorizing the District Attorney to accept the Youth Reinvestment Grant funded through the California State General Fund and administered by the Board of State and Community Corrections in an allocation of $1,000,000.

With this grant funding the District Attorney’s Office will work with RYSE to identify specific felonies and serious misdemeanors for which youth of color are disproportionately arrested, placed on probation, or adjudicated delinquent. Case eligibility for diversion will be determined in a manner that will: avoid discretion in case referral; contain the volume of cases being diverted; avoid net widening; and focus on addressing racial and ethnic disparities.  
  
RYSE will provide trauma-informed and developmentally appropriate wraparound services to the youth offenders, and their victims, whose cases are diverted into the Program. Each youth offender and victim diverted to the Program will complete RYSE’s Restorative Community Conferencing (“RCC”) process in which they will engage in a dialogue to create a remedial plan focused on each victim’s self-identified harm.

CONSEQUENCE OF NEGATIVE ACTION:

The County will be unable to fulfill the agreed upon terms of the Youth Reinvestment Grant funded through the California State General Fund and administered by the Board of State and Community Corrections.
