FISCAL IMPACT:
The Grant Agreement provides Authority funds up to $7,929,855. Remaining project costs will be funded by Flood Control District Zone 3B funds (Fund 252000) or other state and federal grant funds. (Project No. 7520-6B8285)
BACKGROUND:
On December 4, 2018, the Board of Supervisors approved the Flood Control District’s application to the Authority for an amount not to exceed $10,000,000 of Authority Measure AA funding. The Flood Control District subsequently applied for, and the Authority approved, a grant for $7,929,855 for the Lower Walnut Creek Restoration project.
The Authority intends that $1,000,000 of this grant award be passed on to the Flood Control District’s partner, John Muir Land Trust (JMLT), for public access amenities in a future phase of the project. The Flood Control District has a pending agreement with JMLT for the Board’s consideration under a separate item on this agenda.
Under the Grant Agreement, the Flood Control District is obligated to defend and indemnify the Authority for third party claims arising out of the Flood Control District’s negligence or will misconduct in performing the Grant Agreement.
The Authority has requested a Board resolution accepting the grant award and authorizing the Flood Control District to execute the Grant Agreement.
CONSEQUENCE OF NEGATIVE ACTION:
Without Board approval and adoption of the resolution, the Flood Control District will be unable to accept the $7,929,855 Authority grant.
