RECOMMENDATION(S):

APPROVE and AUTHORIZE the Chair, Board of Supervisors, to execute an Employment Agreement with Monica Nino to serve as Contra Costa county Administrator commencing January 4, 2021; ADOPT Position Adjustment Resolution No. 25652 adding one County Administrator position (Exempt) in the County Administrator's Office effective January 1, 2021; and, APPROVE and AUTHORIZE the Chair to execute an amendment to the Employment Agreement between the County and David J. Twa, County Administrator, effective January 1, 2021, through March 30, 2021.

FISCAL IMPACT:

100% General Fund (budgeted).

BACKGROUND:

The Board of Supervisors recently announced its intention to appoint Monica Nino to the position of County Administrator effective January 4, 2021, subject to agreement on terms and conditions. Contract negotiation has been successfully concluded and the Board is asked to approve the attached contract and authorize its execution.

BACKGROUND: (CONT'D)

The attached Position Adjustment Resolution (P300 No. 25652) is to add a second County Administrator position (Exempt) in the County Administrator's Office effective January 1, 2021 to provide for the transition of the current County Administrator's position. This position will be deleted in the spring of 2021.

Also in support of the transition of County Administrator, this action provides for an amendment to the Employment Agreement between the County and David J. Twa, County Administrator, effective January 1, 2021, to authorize an extension of term through March 30, 2021. All other provisions of the current employment contract will remain in full force and effect.

CONSEQUENCE OF NEGATIVE ACTION:

The employment agreement with David Twa will expire and a new County Administrator will not be appointed.

The Employment Agreement of Monica Nino is amended in Section C Termination by County Without Cause, paragragh (1) to add the sentence: For purpose of this section “cash settlement” means all payments the EMPLOYEE is entitled to receive from COUNTY upon termination of employment.
