RECOMMENDATION(S):

ADOPT Resolution No. 2016/654 approving the second extension of the Subdivision Improvement Agreement (Right-of-Way Landscaping) for subdivision SD06-09134, for a project being developed by Shapell Homes, A Division of Shapell Industries, Inc., A Delaware Corporation, as recommended by the Public Works Director, San Ramon (Dougherty Valley) area. (District II)  

FISCAL IMPACT:

No fiscal impact.

BACKGROUND:

The terminal date of Subdivision Agreement (Right-of-Way Landscaping) needs to be extended. (Approximately 90% of the work has been completed to date.) By granting an extension, the County will give the developer more time to complete the improvements and keep the bond current.


CONSEQUENCE OF NEGATIVE ACTION:

The terminal date of the Subdivision Agreement (Right-of-Way Landscaping) will not be extended and the developer will be in default of the agreement, requiring the County to take legal action against the developer and surety to get the improvements installed.
