RECOMMENDATION(S):

AUTHORIZE the Department of Conservation and Development to review the Draft Environmental Impact Report (DEIR) for the Magee Ranch residential subdivision (Subdivision 9291) in the Town of Danville in relation to potential impacts to Diablo Road and the unincorporated community of Diablo, coordinate review of DEIR with Department of Public Works, and, as necessary, submit comments on the DEIR on behalf of the County.

FISCAL IMPACT:

The cost of reviewing the document will be borne by the Department of Conservation and Development and Public Works Department.

BACKGROUND:

The Town of Danville is considering a development application by SummerHill Homes to subdivide an approximately 410-acre site on lands known as the Magee Ranch Property, located southeast of Diablo Road and Green Valley Road/McCauley Road, into 85 single-family lots including 75 lots ranging from 10,000 to 22,000 square feet clustered on approximately 23 acres predominantly along Diablo Road and 10 custom home sites ranging in size from 218,000 square feet to 750,000 square feet. The remaining 302 acres of the site would be preserved as permanent open space.  
  
The project would entail the construction of a new driveway from Diablo Road/Blackhawk Road adjacent to Jillian Way, which would serve as the primary entrance to the subdivision; and, access to the proposed custom homesites would be provided by separate project driveways located near Diablo Road /Clydesdale Drive and south of the intersection of Diablo Road/McCaully Road. The proposed project would require the construction and installation of backbone infrastructure, including water supply, natural gas and electric, sanitary sewer, and stormwater detention facilities among others. The project would also install three bioretention facilities; the proposed custom home-sites would have individual on-site stormwater treatment facilities. The Town of Danville issued a Draft Environmental Impact Report (DEIR) on November 30, 2012 for the Magee Ranch-Summerhill Development Application. Comment period for the DEIR runs sixty (60) days from November 30, 2012 to January 29, 2013.  
  
Due to the proposed project’s proximity to the unincorporated community of Diablo, and the project’s reliance on Diablo Road as the primary point of access, the project may have impacts on the unincorporated area. It is therefore recommended that the Department of Conservation and Development review the DEIR in relation to potential impacts to Diablo Road and the unincorporated community of Diablo, coordinate this review of the DEIR with Department of Public Works, and, as necessary, submit comments on the DEIR to the Town of Danville on behalf of the County.
