RECOMMENDATION(S):

Approve and authorize the Health Services Director, or his designee, to execute, on behalf of the County, an Agreement #28-841 with the American Type Culture Collection (ATCC), a government agency, a non-financial agreement, for reagents obtained for influenza virus testing at Contra Costa County’s Public Health Lab, for the period from November 1, 2012 through October 31, 2013.

FISCAL IMPACT:

This is a non-financial agreement. No County match required.

BACKGROUND:

The purpose of this agreement governs the transfer of research material between ATCC and Contra Costa County for its Public Health Lab. The Agreement protects the ability of the Center for Disease Control and Prevention and ATCC to supply free reagents for the benefit of the public health community. The Agreement defines the duties of the recipient (Contra Costa County, for its Public Health Lab), including the responsibility to properly handle, use, and dispose of the materials according to applicable laws and regulations and restrictions provided herein. The Reagents are given to the Public Health Lab for free, for the purpose of testing for influenza virus.   
  
Approval of Agreement 28-841 protects the rights of all parties involved in the exchange of biomaterials from the original depositor of the material to the end-user through October 31, 2013, including agreeing to mutually indemnify and hold the other party harmless from any claims arising out of the performance of this Contract.  

CONSEQUENCE OF NEGATIVE ACTION:

If this agreement is not approved, the Public Health Lab will not be able to conduct research to prevent the spread of influenza viruses in Contra Costa County.
