RECOMMENDATION(S):

APPROVE and AUTHORIZE the County Administrator, or designee, to execute a contract amendment, effective July 1, 2012, with the Contra Costa County Bar Association to increase the provision for administrative costs by $28,509 to a new provision of $390,549, with no change to the annual contract payment limit of $3,500,000, to provide management and administrative support for the County's criminal conflict defense for indigents program, through June 30, 2013.

FISCAL IMPACT:

100% County General Fund; Budgeted, County Administrator-Conflict Defense Program. The increased allocation for administration represents $24,000 in salary costs and $4,509 in pension and payroll tax expense.










BACKGROUND:

Since 1983, the County has contracted with the Contra Costa County Bar Association for the provision of conflict defense services for indigents. The County developed the Criminal Conflicts Program with the Bar in response to the escalating cost of conflict defense services under the old system of court-appointed counsel. The Criminal Conflicts Program provides Court-ordered legal representation of accused indigents in cases where the Public Defender or Alternate Defender has a legal conflict of interest or is otherwise unavailable, cases where the Public Defender or Alternate Defender is relieved on motions of defendants for other reasons, for certain witnesses, and for juvenile immigration and certain probate/guardianship cases.  
  
The County's current two-year contract with the Bar Association provides for a mid-term review and negotiation of administrative costs. The recommended increase to administrative costs of $28,509 brings the administrative budget to 11% of the total contract cost.
