RECOMMENDATION(S):

APPROVE the conveyance of a portion of Grant Deed of Development Rights by Quitclaim Deed for MS 06-0026 to Hossein Abar and Farzaneh Jabbari, pursuant to Government Code Section 25526.5.  
  

DETERMINE that conveyance of a portion of Grant Deed Development Rights is in the public interest.  

  





RECOMMENDATION(S): (CONT'D)
AUTHORIZE the Chair, Board of Supervisors, to execute the Quitclaim Deed on behalf of the County.  
  
DIRECT the Real Estate Division of the Public Works Department to cause said Quitclaim Deed to be delivered to the Grantee for acceptance and recording in the office of the County Recorder.  

FISCAL IMPACT:

Fees are paid 100% by applicant.

BACKGROUND:

On March 18, 2008, a Grant Deed of Development Rights was granted to Contra Costa County as Condition of Approval, No. 12, for Minor Subdivision 06-0026.   
  
The property owner of 2530 Caballo Ranchero Drive, also identified as Assessor’s Parcel No. 195-351-045, has requested that there be a modification to Condition of Approval No. 12 to decrease the restricted development area, which would allow the property owner to construct back yard improvements.  
  
It has been determined that a portion of the Grant Deed of Development Rights is no longer needed and should be quitclaimed to the underlying fee owners. The remainder of the Grant Deed of Development Rights will stay in place.  
  
On July 20, 2012, the Contra Costa County Department of Conservation and Development filed a Negative Declaration for MS 06-0026 that included quitclaiming a portion of the Development Rights.  

CONSEQUENCE OF NEGATIVE ACTION:

The requested portion of Development rights will not be quitclaimed and will continue to encumber Minor Subdivision 06-0026 and further prevent the property owner from moving forward with their planned improvements.
