RECOMMENDATION(S):

APPROVE and AUTHORIZE the Employment & Human Services Department Interim Director, or designee, to execute a contract amendment with California Department of Education to support childcare and development programs (CalWORKS Stage 2) by increasing the payment limit by 58,599 to a new payment limit not to exceed $3,207,489 with no change to term July 1, 2010 through June 30, 2011.

BACKGROUND:

The Board approved receipt of these funds from the California Department of Education on July 13, 2010; in this agreement the County provides alternative payment / CalWORKS Stage 2 childcare services. The Board approved an amendment to this contract on January 18, 2011 to add $144,354 to the payment limit and to incorporate updated funding terms and conditions for the 2010/11 program year. Subsequently, the board approved a second amendment on July 12, 2011 to amend the number of days of operation to follow the school calendars of districts wherein these services are provided. This third amendment is to accept additional funding, as earned by the County from enrollment data, for the 2010/11 program year. A third amendment was approved by the Board on October 4, 2011 to increase the payment limit by $55,138. This amendment is to increase the payment by a further $58,599. The State routinely allows the County to request receipt of funds up to 3% above the payment limit, dependent upon the County's earning the fees through enrollment and attendance. The earnings for the fiscal year increased as a result of the year-end attendance accruals that exceeded the original Child Days of Enrollment. This amendment will bring the revenue agreement in line with the actual fiscal year earnings for FY 2010-11.  
  
Approval of this contract amendment will allow the County to receive reimbursement for the enrollment for that period.

CONSEQUENCE OF NEGATIVE ACTION:

If not approved, County will not receive revenue.
