AUTHORIZE the Public Works Director, or designee, to execute the License on behalf of the County.
DIRECT the Real Estate Division of the Public Works Department to cause the License to be delivered to the City.

BACKGROUND:
The City of Concord received a federal grant to construct a 1.6-mile long shared use trail that will be begin just north of Monument Boulevard and ending at Market Street/Meadow Lane in Concord. The trail will be located in a portion of the County’s IHC just north of Monument Boulevard at Mohr Lane run to Mayette Avenue, which approximately 1.1 miles. The trail will continue north of Mayette Avenue in City right of way and end at Market Street/Meadow Lane, which is approximately 0.5 miles.
The Trail will consist of a 10-foot wide asphalt pathway with an underlayment of a 16-foot wide lime treated base and decomposed granite with 3-foot wide crushed aggregate shoulders. The City will be responsible to maintain the trailhead and landscaping improvements it installs within the IHC from Monument Boulevard to Mayette Avenue.
Construction of the trail by the City is consistent with existing County policy providing for public use of the IHC and will not conflict with the County’s development of a future transit corridor.
Under section 22 of the License, County agrees to indemnify City for harm or damage caused by County's use of herbicides within the IHC.
CONSEQUENCE OF NEGATIVE ACTION:
The City will not be able to construct the trail and lose their funding.
