RECOMMENDATION(S):

APPROVE and AUTHORIZE the Assignment of Easement on behalf of Contra Costa County (County) to the City of Pittsburg (City) over a portion of land owned by Pittsburg Unified School District (PUSD), APN 087-341-020, located at the west end of Frontage Road west of Burton Avenue and FIND that the Easement is not required for County use pursuant to Government Code Section 25365. Project 4660-6X4287, SCG No. 200012007.

AUTHORIZE the Chair, Board of Supervisors, to execute said Assignment of Easement on behalf of the County.

RECOMMENDATION(S): (CONT'D)
DIRECT THE Real Estate Division of the Public Works Department to deliver a certified copy of the Board Order and Assignment of Easement to City for acceptance and recording in the office of the County Recorder.

FISCAL IMPACT:

The activity is funded 100% by Contra Costa Transportation Authority.

BACKGROUND:

The County acquired various property rights in connection to the highway widening project. One of the property rights acquired was a grant of easement for public utilities from PUSD because several utilities needed to be relocated to accommodate the widening of Highway 4. The County needs to assign the easement rights to the City.

CONSEQUENCE OF NEGATIVE ACTION:

The City would not have the easement rights as required by the approved plans and specifications for the project and the County would retain ownership of a Grant of Easement in the City.

CHILDREN'S IMPACT STATEMENT:

Not applicable.
