RECOMMENDATION(S):

1. APPROVE a Sublease with Blackhawk Business Center, Inc. dba Danville Business Center, for a term commencing upon the completion of phone and data equipment installation, and ending April 30, 2013, for 195 square feet of office space at 4115 Blackhawk Plaza Circle, Suite 100, Office 19, Danville, at a total occupancy cost of $1,160 per month for occupancy by the District 3 Supervisor, under the terms and conditions set forth in the Sublease.  
  

2. AUTHORIZE the Deputy General Services Director, or designee, to EXECUTE the Sublease, and EXERCISE any option to extend the Sublease.

3. DETERMINE that the project is a Class 1(a) Section 15301 Categorical Exemption under the California Environmental Quality Act (CEQA). (CP#11-72; WLP742)  
  
4. DIRECT the Department of Conservation and Development Director, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Deputy General Services Director, or designee, to arrange for the payment of the handling fees to the Department of Conservation and Development and County Clerk for filing of the Notice of Exemption.  

FISCAL IMPACT:

Assuming the District 3 Supervisor occupies the premises by January 1, 2012, this Sublease will obligate the County to pay a total occupancy expense, including rent and other expenses, of approximately $18,560 ($1,160/mo.) over the 16 month term of the Sublease. The new Sublease contains a provision that will allow the County to terminate the Sublease upon sixty (60) days notice to the Sublessor, and avoid the above monthly expenses. 100% General fund.

BACKGROUND:

In 2011, the Board of Supervisors approved a redistricting plan which realigned supervisorial districts. With the realignment, the Town of Danville was made a part of District 2 rather than District 3. This necessitated the District 3 Supervisor to vacate her existing offices in downtown Danville. However, the District 3 Supervisor’s district still includes the communities of Diablo, Blackhawk, and Camino Tassajara. After an extensive search for new office space in those communities, an office at 4115 Blackhawk Plaza Circle, Suite 100, Office 19, Danville was selected. No available County-owned facilities in those communities were found that would accommodate an office for the District 3 Supervisor.

CONSEQUENCE OF NEGATIVE ACTION:

If the Sublease is not approved, the District 3 Supervisor will not have a nearby office to serve the communities of Diablo, Blackhawk, and Camino Tassajara.
