RECOMMENDATION(S):

APPROVE Notice of Intention to Convey Real Property, identified as the old Fire Station 93 at 215 Second Street, APN 035-131-002, to the City of Oakley pursuant to Government Code Section 25365, and   
  

DETERMINE that the project is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Article 5, Section 15061 (b) (3) of the CEQA Guidelines, and   

  




RECOMMENDATION(S): (CONT'D)
DIRECT the Director of the Department of Conservation and Development (DCD) to file a Notice of Exemption with the County Clerk, and   
  
AUTHORIZE the Public Works Director to arrange for payment of a $50.00 handling fee to the County Clerk for filing and a $25.00 fee to DCD for processing of the Notice of Exemption.   
  
DECLARE that this Board will meet on January 10, 2012 at 9:30 a.m. or thereafter, in the Board’s Chambers, County Administration Building, 651 Pine Street, Martinez, California, to consummate the conveyance.  
  
DIRECT Clerk of the Board to publish the attached notice in the Contra Costa Times pursuant to Government Code Section 6061.   
  

FISCAL IMPACT:

No fiscal impact.  

BACKGROUND:

Contra Costa County intends to transfer real property identified as the old Fire Station 93 at 215 Second Street, APN 035-131-002, to the City of Oakley pursuant to the terms and conditions of the “Agreement Among The East Contra Costa County Fire Protection District, The County of Contra Costa, The City of Oakley, And The Oakley Redevelopment Agency For The Oakley Fire Station Replacement Project” approved by the Board of Supervisors on January 26, 2010, Item C.43. General Plan conformance has been obtained from the City of Oakley.

CONSEQUENCE OF NEGATIVE ACTION:

The County will not be in compliance with the terms and conditions of the Agreement and will continue to be responsible for the maintenance of the Property.
