RECOMMENDATION(S):

APPROVE and AUTHORIZE the Board Chair and the Public Works Director, or their designees, to execute the Easement Purchase Agreement and Grant of Easement to Central Contra Costa Sanitary District (District) in connection with their M-4A Forcemain Replacement Project along Waterfront Road, pursuant to Government Code Section 25526.6, and  
  

ACCEPT the Quitclaim Deed from the District, and   

  




RECOMMENDATION(S): (CONT'D)
DETERMINE that the project is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Article 5, Section 15061 (b) (3) of the CEQA Guidelines, and   
  
DIRECT the Director of the Department of Conservation and Development (DCD) to file a Notice of Exemption with the County Clerk, and   
  
AUTHORIZE the Public Works Director to arrange for payment of a $50.00 handling fee to the County Clerk for filing and a $25.00 fee to DCD for processing of the Notice of Exemption.   
  
DETERMINE that the conveyance of said easement is in the public interest and will not substantially conflict or interfere with Contra Costa County’s (County) use of the property.  
  
DIRECT the Real Property Division of the Public Works Department to deliver a certified copy of this Board Order and the Grant of Easement to the District for acceptance and recording in the office of the County Recorder and DIRECT the Real Property Division to have said Quitclaim Deed recorded in the Office of the County Recorder.   

FISCAL IMPACT:

No fiscal impact.  

BACKGROUND:

The District has relocated portions of its M4-A Forcemain pipeline and above ground sewer pipeline in Waterfront Road and constructed an emergency bypass and drainback structure at its Fairview Pumping Station. When inspecting the pipelines in Waterfront Road, the District discovered leaks that could be attributed to the tidal action of the bay and significant vibrations from trains along with the heavy truck traffic on Waterfront Road. The land in this area is unstable as it is made up various types of fill used to construct Waterfront Road in the 1950’s. This soil continues to undergo consolidation and settlement from the fill placement.   
  
To prevent further damage to their pipelines, the District’s asked the County for a new easement which is further from the road and train tracks from the pipeline. The District has relocated their pipelines to the new easement area under a Right of Entry with the County. The District has placed various types of stabilizing foundation materials and flexible pipelines to help alleviate damages. This activity has been found to conform to the General Plan of the City of Martinez.  
  

CONSEQUENCE OF NEGATIVE ACTION:

The District will have to remove their pipelines and the County would not be in compliance with the terms and conditions of the Right of Entry.
