RECOMMENDATION(S):

1. APPROVE a Lease with Brentwood Walnut B, LLC, commencing upon the completion of tenant improvements and ending April 30, 2013, for 2,107 square feet of office space at 3361 Walnut Boulevard, Suite 140, Brentwood, for occupancy by the District 3 Supervisor, under the terms and conditions set forth in the Lease.  
  

2. AUTHORIZE the Deputy General Services Director, or designee, to EXECUTE the Lease, and EXERCISE any option to extend the Lease.  

  




RECOMMENDATION(S): (CONT'D)
3. DETERMINE that the project is a Class 1(a) Section 15301 Categorical Exemption under the California Environmental Quality Act (CEQA). (CP#11-71; WLP742)  
  
4. DIRECT the Department of Conservation and Development Director, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Deputy General Services Director, or designee, to arrange for the payment of the handling fees to the Department of Conservation and Development and County Clerk for filing of the Notice of Exemption.  

FISCAL IMPACT:

Assuming the tenant improvements are completed by December 31, 2011, this new Lease will obligate the County to pay total rent of approximately $75,840 ($4,740 per month) over the 16 month term of the Lease, and approximately $43,930 for tenant improvements. The new Lease will also allow the County to terminate the District 3 Supervisor's existing lease in Brentwood at a rental amount of $2,976 per month and to vacate her current office in Danville for potential occupancy by the District 2 Supervisor.

BACKGROUND:

In 2011, the Board of Supervisors approved a redistricting plan which realigned supervisorial districts. With the realignment, the Town of Danville was made a part of District 2 rather than District 3. This necessitated the District 3 Supervisor to vacate her offices in Danville. Since the District 3 Supervisor’s existing office in Brentwood is not large enough to accommodate the District 3 Supervisor’s displaced staff from Danville, new offices in East county were required. After an extensive search for new office space in East county, the premises at 3361 Walnut Boulevard, Suite 140 in Brentwood were identified. No County-owned facilities in East county were identified that would accommodate an office for the District 3 Supervisor.  
  

CONSEQUENCE OF NEGATIVE ACTION:

If the Lease is not approved, the District 3 Supervisor will not have an office of sufficient size in her district to accommodate her staff.
