FIND the project is a California Environmental Quality Act (CEQA), Class 1c Categorical Exemption, pursuant to Article 19, Section 15301(c) of the CEQA Guidelines, and  
  
DIRECT the Director of Conservation and Development to file a Notice of Exemption with the County Clerk, and  
  
AUTHORIZE the Public Works Director to arrange for payment of $25 fee to Conservation and Development for processing, and a $50 fee to the County Clerk for filing the Notice of Exemption.  

FISCAL IMPACT:

This project is funded with federal and Local Road Funds (Federal Funds (STIP) 73.5%, Local Road Funds 26.5%).

BACKGROUND:

The purpose of this project is to provide a hot mix asphalt (HMA) overlay on Kirker Pass Road from approximately 1.5 miles west of the Pittsburg City Limits to the Pittsburg City Limits. Kirker Pass Road is a rural arterial connecting the City of Concord and the City of Pittsburg that crosses over Kirker Pass. It is a commuter route with an average daily traffic (ADT) of approximately 22,000 vehicles.   
  
This segment of Kirker Pass Road last received an overlay in 1990 and a slurry seal in 2003. As a pavement surface ages, small surface cracks appear that allow moisture to infiltrate into the pavement section, causing it to weaken. Applying an HMA overlay to the pavement will provide additional structural strength to the roadway and extend the life of the pavement.   
  
The project will also include crack sealing, pavement grinding, placement of pavement reinforcing fabric, replacement of existing striping, pavement markings, and three existing guardrails, minor concrete median modification, crash cushion grade adjustments, and adjustment of existing inlet grates to grade.   
  
The project will require pavement and base failure repairs requiring excavation of the existing roadway in some locations. No work that interferes with traffic flow will be performed during commute hours. One lane of traffic will be closed for construction with flagmen controlling traffic during construction activities that will only occur during non-commute times. Work may be required during night and/or weekend hours. Emergency vehicle access will be allowed at all times. A construction staging area has been identified in a previously disturbed area within the existing road right-of-way along the shoulders of Nortonville Road just south of its intersection with Kirker Pass Road.   
  
The project is within the East Contra Costa County HCP Service Area but the project will occur entirely within previously disturbed areas not subject to HCP Fees. The County will conduct applicable avoidance and minimization measures dictated by the HCP. Real Property transactions and utility relocations may be necessary in support of this project.

CONSEQUENCE OF NEGATIVE ACTION:

Delay in approving the project will result in a delay of design and construction and may jeopardize funding.
