RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute Amendment No. 4, effective September 13, 2011, to an existing Consulting Services Agreement with T.Y. Lin International to increase the current payment limit by $15,755 to a new payment of $699,130 in order to provide design and environmental services for the Orwood Road Bridge Replacement Project, Brentwood, Byron area. (Project No. 0662-6R4076)

FISCAL IMPACT:

The Consulting Services Agreement Amendment allows for an additional $15,755 above the previously approved contract payment limit of $683,375. The increase in payment is to be funded by 80% Federal Funds and 20% Road funds.

BACKGROUND:

The existing Orwood Road Bridge was constructed in 1947. The bridge is constructed primarily of wood components. As a result of its age and exposure to a marine environment, the bridge is coming to the end of its serviceable life.

On May 5, 2005, the Board of Supervisors approved the Consulting Services Agreement (CSA) for design of the bridge replacement project with T.Y. Lin International.  
  
On November 27, 2007, the Board approved Amendment No. 1 to the Consulting Services Agreement to increase the payment limit by $78,650 for additional bridge design services due to modifications to the bridge design. The modifications included adding an 8-foot wide pedestrian trail on the new bridge and modifying the approach roadway design to minimize the impacts to adjacent property owners.  
  
On June 23, 2009, the Board approved Amendment No. 2 to the Consulting Services Agreement to increase the payment limit by $68,320 in order to provide environmental consulting services.  
  
On April 5, 2011, the Board approved Amendment No. 3 to the Consulting Services Agreement to increase the payment limit by $125,289 in order to provide additional environmental consulting services and project management services.  
  
Recently, Caltrans Local Assistance Office required this project to perform a bioacoustics impact assessment. This assessment is unanticipated work. The proposed amendment will amend payment limits and scope of work to that described in the Agreement.  

CONSEQUENCE OF NEGATIVE ACTION:

Public Works staff does not have the expertise to perform this work in-house. Negative action will result in the Public Works Department having to hire other environmental consultants, which will delay project completion and possibly jeopardize Federal funding.
