RECOMMENDATION(S):

RECEIVE this report concerning the final settlement of Yi-Ming Tsang and AUTHORIZE payment from the Workers' Compensation Internal Service Fund in an amount not to exceed $63,000, less permanent disability advances.

FISCAL IMPACT:

Workers' Compensation Internal Service Fund payment of $63,000, less permanent disability advances.

BACKGROUND:

Attorney Sara A. Grumley, defense counsel for the County has advised the County Administrator that within authorization, an agreement has been reached settling the workers' compensation claim of Yi-Ming Tsang v. Contra Costa County Risk Management. The Board's November 1, 2011 closed session vote was Supervisors Gioia, Uilkema, Mitchoff and Glover - Yes. Supervisor Piepho - No. This action is taken so that the terms of this final settlement and the earlier November 1, 2011 closed session vote of this Board authorizing its negotiated settlement are known publicly.

CONSEQUENCE OF NEGATIVE ACTION:

Case will not be settled.
