RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute Amendment No. 1, effective November 15, 2011, to an existing Consulting Services Agreement with Caltrop Corporation to increase the current payment limit by $10,000 to a new payment of $139,985 in order to provide construction management services for the Alhambra Valley Road Safety and Bicycle Facility Improvements Project, Martinez Area. (Project No. 0662-6R4095)

FISCAL IMPACT:

The Consulting Services Agreement Amendment allows for an additional $10,000 above the previously approved contract payment limit of $129,985. The increase in payment is to be funded by Road funds (100%).










BACKGROUND:

On July 12, 2011, the Board of Supervisors approved the Consulting Services Agreement (CSA) with Caltrop Corporation to provide professional construction management services for the Alhambra Valley Road Safety and Bicycle Facility Improvement – East of Castro Ranch Road project. Construction management services are required for the construction of this project. Caltrop was selected to provide these services after completing a request for qualifications solicitation, County Outreach, and interview process. They have been assisting County staff by providing construction inspection, contract administration and resident engineer services.   
  
The proposed amendment will increase the payment limits originally described in the Agreement. The amendment is needed due to unanticipated project conditions which required additional project oversight by Caltrop staff.

CONSEQUENCE OF NEGATIVE ACTION:

If the amendment is not approved, Caltrop Corporation cannot be paid for the additional required work and the construction of the project may be delayed.
