RECOMMENDATION(S):

APPROVE and AUTHORIZE the Agricultural Commissioner, or designee, to execute the Cooperative Agreement for the Light Brown Apple Moth (LBAM) with the California Department of Food and Agriculture (CDFA) in an amount not to exceed $4,789 for regulatory work for the period October 1, 2011 through December 31, 2011, as recommended by the Agricultural Commissioner.  

FISCAL IMPACT:

This agreement reimburses the County for expenditures incurred between October 1, 2011 through December 31, 2011, not to exceed $4,789.










BACKGROUND:

The Light Brown Apple Moth (LBAM) was first detected in Contra Costa County on March 7, 2007. In addition, LBAM is also found infesting all San Francisco Bay Area counties with incipient infestations in some other coastal and inland counties. On May 2, 2007 the United States Department of Agriculture (USDA) issued a Federal Domestic Quarantine Order (DA-2007-42), regulating the interstate movement of host material from the infested areas of California and all of Hawaii. This regulation requires all nurseries, green waste facilities, community gardens and harvested commodities within the infested areas be issued a quarantine compliance agreement and be periodically inspected prior to movement of host material to non infested areas of the state and country.  
  
The State of California Department of Food and Agriculture has established funding for reimbursing the County for expenditures incurred for performing regulatory work for the Light Brown Apple Moth, which includes implementing the Federal Domestic Quarantine, in addition to conducting emergency response activities as result of detections of LBAM in regulated establishments.   

CONSEQUENCE OF NEGATIVE ACTION:

Failure to accept Agreement #11-0422-SF will mean that the Department will not be reimbursed for performing required regulatory work for the Light Brown Apple Moth.
