RECOMMENDATION(S):

Approve and authorize the Health Services Director, or his designee, to execute, on behalf of the County, Contract Amendment Agreement #26-701 with Medicus Emergency Room Medicine Services West, LLC, a limited liability company, effective August 1, 2011, to amend Contract #26-701, to modify the Payment Provisions to include provisions to reimburse the Contractor for travel expenses, with no change in the original Payment Limit of $275,000 and no change in the original term for the period from August 1, 2011 through July 31, 2012.

FISCAL IMPACT:

No change to original Payment Limit of $275,000. This Contract is funded 100% by Enterprise Fund I.

BACKGROUND:

On August 16, 2011, the Board of Supervisors approved Contract #26-701 with Medicus Emergency Room Medicine Services West, LLC, for the period from August 1, 2011 through July 31, 2012, for the provision of temporary physician services for the Emergency Room at Contra Costa Regional Medical Center to cover during vacation, sick leave and extended leave relief for County-employed physicians.

Due to an administrative oversight provisions to reimburse Contractor for travel expenses was omitted from the formal Contract. It was the intent of the County that the Contractor be reimbursed for these expenses therefore this amendment will reform the Payment Provisions to add language for expense reimbursement.   
  
Approval of Contract Amendment Agreement #26-701-1 will reform the Contract, to make the formal Contract consistent with the oral agreement, which was negotiated with the Contractor with no change in the Payment Limit or the term and allow the Contractor to continue providing services, through July 31, 2012.  

CONSEQUENCE OF NEGATIVE ACTION:

If this amendment is not approved, the Contractor will not be reimbursed for travel expenses which were inadvertently omitted from the Contract.
