RECOMMENDATION(S):

1. OPEN the public hearing on Resolution No. 2009/551, RECEIVE testimony, and CLOSE the hearing.  
  

2. ADOPT Resolution No. 2009/551 establishing a $10 base fee for recording and indexing the first page of every document required or permitted to be recorded.  

FISCAL IMPACT:

The increase in fees will generate approximately $1,800,000 in new revenues each year, depending on the volume of documents that are recorded.




BACKGROUND:

An analysis was conducted with the assistance of the Auditor/Controller to determine the current costs associated with processing documents to be recorded and indexed. The analysis shows that Contra Costa County does not recover the full costs it incurs in providing those services. Adoption of the new fees will allow the County to recover most of the costs of providing the mandated duties of recording and indexing documents for the public record. Tables showing the Recorder fee calculations were made available to the public before the introduction of this resolution.  
  
SB 676 (Chapter 606) Section 2 Government Code 27361 is amended to read: 27361. (a) The fee for recording and indexing every instrument, paper or notice required or permitted by law to be recorded shall not exceed ten dollars ($10) for recording the first page and three dollars ($3) for each additional page, to reimburse the county for the costs of services rendered pursuant to this subdivision.  
  

CONSEQUENCE OF NEGATIVE ACTION:

Failure to increase the base recording fee will cause the county to not be able to collect new revenues, customer service will remain at the reduced level and the County will not be able to recover most of the cost to provide the recording and indexing services.
