RECOMMENDATION(S):

APPROVE and AUTHORIZE the Health Services Director, or designee, to execute on behalf of the County Grant Agreement #28-511-46 (EA33-22-0017) with the California Department of Resources Recycling and Recovery (CalRecycle), including indemnification, to pay County an amount not to exceed $26,112, for continuation of the Local Enforcement Agency (LEA) assistance funds for the Department's Environmental Health Division Solid Waste Program, for the period July 1, 2022 through October 27, 2023.

FISCAL IMPACT:

Approval of this agreement will result in a payment to the County of $26,112 for the Department's Solid Waste Program. No County match required.

BACKGROUND:

The CalRecycle provides these grants annually to assist Statewide LEA in performing their duties. Pursuant to Public Resources Code Section 43230, this grant award will be used solely for the support of the solid waste facilities permit and inspection programs, including personnel, training, equipment, supplies, and technical support. The County has been receiving funds from CalRecycle for the Solid Waste Program since January 1991.  
  
On September 14, 2021, the Board of Supervisors approved Grant Agreement #28-511-44 in an amount of $25,081 payable to the County from CalRecycle for the LEA Grant Program, to provide funding for the Department’s Environmental Health Division Solid Waste Program, for the period from July 1, 2021 through October 27, 2022.   
  
On May 17, 2022, the Board of Supervisors authorized the Health Services Department to submit funding application #28-511-43 for continuation of funding for the Solid Waste Program for the period July 1, 2022 through October 27, 2023.  
  
The County received this grant agreement from CalRecycle on September 15, 2022.  
  
Approval of Grant Agreement #28-511-45 will allow the County to continue to use the funds solely for the support of the solid waste facilities permit and inspection programs, including personnel, training, equipment, supplies, and technical support. This agreement includes agreeing to indemnify and hold harmless the grantor from any claims arising out of the performance of this grant agreement through October 27, 2023.

CONSEQUENCE OF NEGATIVE ACTION:

If this agreement is not approved, the County will not receive funds to support its solid waste facilities permit and inspection programs.
