RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a contract with Zero Foodprint, in an amount not to exceed $30,000 for compost broker pilot project services for the period November 1, 2022 through October 31, 2023, Countywide.

FISCAL IMPACT:

Work performed under this contract is funded 100% by the Department of Conservation and Development SB 1383 Grant.













BACKGROUND:

The Public Works Department is responsible for compliance with Senate Bill 1383 regulations regarding recovered organic waste product procurement requirements, as described in the California Code of Regulations Title 14, Division 7, Chapter 12, Article 12 – Procurement of Recovered Organic Waste Products (14 CCR 18993.1 et seq.). Zero Foodprint, a California nonprofit corporation for public benefit, provides compost and mulch procurement and transportation coordination services for the purposes of facilitating compliance with SB 1383. For that reason, the Public Works Department selected Zero Foodprint to perform compost broker services for a one (1) year pilot term. Public Works anticipates that these services will assist in determining the feasibility in complying with SB 1383 utilizing organic waste derived compost and mulch, in addition to complying with the regulations. This Contract includes modified insurance language, which was approved by Risk Management.  
  
Government Code Section 31000 authorizes the County to contract for services including the type of compost broker services that Zero Foodprint provides.

CONSEQUENCE OF NEGATIVE ACTION:

Without the approval of the Board of Supervisors, Public Works Department will be unable to obtain compost broker services from Zero Foodprint to comply with SB 1383.
