RECOMMENDATION(S):

ADOPT Resolution No. 2017/344 approving the third extension of the Subdivision Agreement (Right-of-Way Landscaping) for subdivision SD06-09134, for a project being developed by Shapell Homes, a Division of Shapell Industries, Inc., a Delaware Corporation, as recommended by the Interim Public Works Director, San Ramon (Dougherty Valley) area. (District II))  

FISCAL IMPACT:

No fiscal impact.

BACKGROUND:

The terminal date of the Subdivision Agreement (Right-of-Way Landscaping) needs to be extended. The developer has not completed the required improvements and has requested more time. (Approximately 95% of the work has been completed to date.) By granting an extension, the County will give the developer more time to complete his improvements and keeps the bond current.  



CONSEQUENCE OF NEGATIVE ACTION:

The terminal date of the Subdivision Agreement (Right -of -Way Landscaping) will not be extended and the developer will be in default of the agreement, requiring the County to take legal action against the developer and surety to get the improvements installed.
