RECOMMENDATION(S):

ADOPT Resolution No. 2015/368, approving the side letter between Contra Costa County and Professional & Technical Engineers, Local 21 to limit hours worked by retiree temporary employees, as recommended by the County Administrator.

FISCAL IMPACT:

None. This is an administrative agreement and has no fiscal impact on its own.

BACKGROUND:

The maximum number of hours a retiree temporary employee can work is 960 hours per fiscal year. Due to limited automation, it has been difficult to police the maximum number of hours worked by retiree temporary workers. By policy the County limits retiree temporary employees, with the exception of Local 21 represented temps, to 900 hours in order to remain within the 960 hour maximum limit. Local 21 represents retiree temporary workers in Local 21 represented classifications. The County and Local 21 have agreed to a penalty for exceeding the maximum hours in a fiscal year. Beginning with the current fiscal year, if a retiree exceeds the maximum hour limit he/she will not work for the County as a retiree temporary in the following fiscal year.



CONSEQUENCE OF NEGATIVE ACTION:

If the side letter is not approved, retiree temps who exceed 960 hours per fiscal year might continue to work in the next fiscal year.
