RECOMMENDATION(S):

ADOPT Resolution No. 2016/5 approving the eighth extension of the Drainage Improvement Agreement for drainage acceptance DA04-00035 (cross-reference SD99-08381), for a project being developed by Shapell Homes, a Division of Shapell Industries, Inc., a Delaware Corporation, as recommended by the Public Works Director, Danville area. (District III)  
  

FISCAL IMPACT:

No fiscal impact.

BACKGROUND:

The terminal date of the Drainage Improvement Agreement needs to be extended. The developer has not completed the required improvements and has requested more time. (Approximately 75% of the work has been completed to date.) By granting an extension, the County will give the developer more time to complete the improvements and keeps the bond current.


CONSEQUENCE OF NEGATIVE ACTION:

The terminal date of the Drainage Improvement Agreement will not be extended and the developer will be in default of the agreement, requiring the County to take legal action against the developer and surety to ensure completion of the improvements.
