RECOMMENDATION(S):

RECEIVE public report of litigation settlement agreements that became final during the period of December 1, 2012 through December 31, 2012, as recommended by County Counsel.

BACKGROUND:

One agreement to settle pending litigation, as defined in Government Code section 54956.9, became final during the period of December 1, 2012 through December 31, 2012.

Jill Henderson v. Contra Costa County, U.S.D.C. Case No. C12-4945 MEJ (N.D.Cal.); In re Merit Board Complaint of Jill Henderson. The plaintiff filed a complaint with the Merit Board alleging political retaliation and filed a federal lawsuit alleging retaliation and discrimination. As part of a settlement and release agreement, the Board of Supervisors authorized a total payment of $135,000 to the plaintiff, inclusive of attorney fees and costs, in exchange for a full release of all claims and dismissal of the Merit Board complaint and federal lawsuit. The Board of Supervisors authorized settlement on October 23, 2012 in closed session, by a 4-1 vote, Supervisor Piepho opposed. The settlement became final on December 13, 2012. The settlement amount will be paid from the District Attorney’s budget.   
  
This report includes final settlements of litigation matters handled by the Office of the County Counsel. This report does not include litigation settlements that were reported by the Risk Management Division of the County Administrator’s Office as a consent item on the Board’s open session agenda.  

CONSEQUENCE OF NEGATIVE ACTION:

The report would not be accepted.
