RECOMMENDATION(S):

Approve and authorize the Health Services Director, or his designee, to execute, on behalf of the County, Standard Agreement #74–208–10 (11-79007-000) with the California Department of Mental Health, a government agency, in an amount not to exceed $2,397,864, for the purchase and use of state hospital beds, for the period from July 1, 2011 through June 30, 2012.

FISCAL IMPACT:

This Contract is funded 100% by Mental Health Realignment. This renewal reflects an increase in daily bed rate. No cost to County.

CONSEQUENCE OF NEGATIVE ACTION:

If this contract is not approved, the County will not be able to pay Contractor for bed usage for mentally ill patients.







BACKGROUND:

In previous years, the agreement to purchase State hospital beds was a part of the Mandated County Performance Contract, as required by Section 5650 of the Welfare and Institution Code. Since fiscal year 2002/2003, the purchase of state hospital beds has been separated from the Performance Contract, making it a stand-alone agreement. On June 7, 2011, the Board of Supervisors approved Standard Agreement #74–208–9 with the State Department of Mental Health, for the period from July 1, 2010 through June 30, 2011, for the purchase and use of state hospital beds. The County was just notified by the State Department of Mental Health with regard to this renewal agreement.  
  
Approval of Standard Agreement #74–208–10 will allow County to continue to compensate the State and the State agrees to provide bed usage, including staffing, facilities, equipment, and supplies through June 30, 2012, including agreeing to indemnify and hold the State harmless for any claims arising out of the County’s performance under the Agreement.
