RECOMMENDATION(S):

RESCIND Board action of September 11, 2012 regarding the reappointment of Dr. Michael Zwerdling’s to the District II Seat of the First 5 Contra Costa Children and Families Commission, as recommended by Supervisor Andersen.

FISCAL IMPACT:

None.

BACKGROUND:

Dr. Michael Zwerdling’s term as District II Commissioner of the First 5 Contra Costa Children and Families Commission expired on September 11, 2012. Supervisor Andersen met with Dr. Zwerdling, who indicated that he could only serve as District II Commissioner until December 31, 2012. On September 11, 2012, the Board of Supervisors voted to reappoint Dr. Michael Zwerdling to the District II Seat of the First 5 Contra Costa Children and Families Commission with a term expiring on December 31, 2012.

BACKGROUND: (CONT'D)
First 5 Contra Costa Children and Families Commission’s bylaws state that all appointments are required to be for three year terms except to fill term vacancies. Since Dr. Zwerdling’s reappointment was for a term less than three years, the September 11, 2012 board order is being rescinded. Dr. Zwerdling will continue to serve as a commissioner until a successor is appointed.

CONSEQUENCE OF NEGATIVE ACTION:

If the Board of Supervisors does not rescind the September 11, 2012 Board Order, the appointment will not conform with Contra Costa County Ordinance Code Section 26-14.010 (d) and First 5 Contra Costa Children and Families Commission Bylaws Section 4(e).

CHILDREN'S IMPACT STATEMENT:

None.
