RECOMMENDATION(S):

ADOPT Wendt Ranch GHAD Resolution No. 2013/01 vesting the GHAD Board with authority to appoint the GHAD Attorney and confirming Patricia Curtin to continue to serve as GHAD Attorney.

FISCAL IMPACT:

The GHAD is funded 100% through assessments levied on properties within the GHAD. Therefore, there is no impact on the County General Fund.

BACKGROUND:

Pursuant to Resolution 2008/01, the GHAD Board authorized the GHAD Manager to select legal counsel to provide services to the GHAD. In order to make it clear that the GHAD Attorney represents the GHAD as an entity, it is recommended that the GHAD Board appoint the GHAD Attorney. This appointment process would be the same as the process approved by the GHAD Board for the Blackhawk and Canyon Lakes GHADs in March 2011.

CONSEQUENCE OF NEGATIVE ACTION:

The GHAD Attorney will continue to be appointed by the GHAD Manager and not the GHAD Board.
