RECOMMENDATION(S):

ADOPT Blackhawk GHAD Resolution No. 2013/02 acknowledging change in law firm of GHAD Attorney and confirming appointment of GHAD Attorney.

FISCAL IMPACT:

The GHAD is funded 100% through assessments levied on properties within the GHAD. Therefore, there is no impact on the County General Fund.

BACKGROUND:

On March 15, 2011, the Board vested itself with the authority to appoint the GHAD Attorney. Before this action was taken, the GHAD Manager was vested with the authority to appoint the GHAD Attorney. The GHAD Board appointed Morgan Miller Blair to serve as GHAD Attorney. Patricia Curtin, who has been serving as GHAD Attorney since 2008, is no longer with Morgan Miller Blair. It is recommended that the Board confirm its appointment of GHAD Attorney to Patricia Curtin, and remove the reference to the law firm of Morgan Miller Blair, which no longer exists. (Resolution 2013/02)

CONSEQUENCE OF NEGATIVE ACTION:

The GHAD Manager/Clerk will continue to serve in an “Interim” capacity and the name of the new law firm of the GHAD Attorney will not be set forth in a resolution.

CHILDREN'S IMPACT STATEMENT:

None.
