RECOMMENDATION(S):

ADOPT Resolution No. 2012/12 accepting completion of improvements for minor subdivision MS 01-00002, as recommended by the Public Works Director, Kensington area. (District I)

FISCAL IMPACT:

No fiscal impact to County Funds. The funds to be released are developer fees that have been held on deposit pending completion of the warranty period.

BACKGROUND:

The developer completed the improvements as required in the improvement plans and in conformance with the County Ordinance Code, per the Subdivision Agreement.

CONSEQUENCE OF NEGATIVE ACTION:

The improvements will not be accepted as complete, the Subdivision Agreement and performance/maintenance surety bond will not be exonerated, and the billing account will not be liquidated and closed.
