RECOMMENDATION(S):

ADOPT Resolution No. 2012/21 accepting completion of improvements for drainage improvement agreement DG 03-00025 (cross-reference subdivision SD 00-08507), for project being developed by Windemere BLC Land Company, LLC as recommended by the Public Works Director, San Ramon (Dougherty Valley) area. (District II)

FISCAL IMPACT:

No fiscal impact to County Funds. The funds to be released are developer fees that have been held on deposit.

BACKGROUND:

The developer completed the drainage improvements several years ago, however, the acceptance was pending the approval by the Regional Water Quality Control Board.

CONSEQUENCE OF NEGATIVE ACTION:

The drainage improvements will not be accepted as complete, the Subdivision Agreement and performance/maintenance surety bond will not be exonerated, and the billing account will not be liquidated and closed.
