RECOMMENDATION(S):

Approve and authorize the Health Services Director, or his designee, to execute, on behalf of the County, Novation Contract #24–933–28 with Crestwood Behavioral Health, Inc., a corporation, in an amount not to exceed $7,543,000, to provide subacute skilled nursing care services for the period from July 1, 2011 through June 30, 2012. This Contract includes a six-month automatic extension through December 31, 2012, in an amount not to exceed $3,771,500.

FISCAL IMPACT:

This Contract is funded 12% by Mental Health Services Act and 88% by Mental Health Realignment. There is no increase in the fee rates set forth in this Contract. The total payment limit maximum has increased due to volume.

BACKGROUND:

This Contract meets the social needs of County’s population in that it provides subacute skilled nursing care services for County’s Seriously and Persistently Mentally Ill (SMPI) and neurobehavioral clients.

BACKGROUND: (CONT'D)

On March 1, 2011, the Board of Supervisors approved Contract #24-933-27 with Crestwood Behavioral Health, Inc. for the period from January 1, 2011 through June 30, 2011 which included a six-month automatic extensions through December 31, 2011, for the provision of subacute skilled nursing care for County’s Seriously and Persistently Mentally Ill (SMPI) and Neurobehavioral clients.

Approval of Novation Contract #24-933-28 replaces the automatic extension under the prior Contract and allows the Contractor to continue providing services through June 30, 2012, including mutual indemnification to hold harmless both parties for any claims arising out of the performance of this Contract.

CONSEQUENCE OF NEGATIVE ACTION:

The Mental Health Division places clients at Contractor's facilities licensed for various levels of care. If the contract is not approved, a significant number of mentally ill young adults and adults may be displaced to the community without the mental health services they require.
