RECOMMENDATION(S):

APPROVE and AUTHORIZE the Department of Conservation and Development Director, or her designee, to execute a contract amendment with Insignia Environmental to extend the term from December 31, 2011 to April 30, 2012, with no increase in the payment limit, to allow continued service to complete the Final Avian and Bat Monitoring Report for the Buena Vista Wind Energy Project.

FISCAL IMPACT:

The original payment limit of $594,935 remains unchanged. The contract amount is paid by permit fees paid by the applicant.

BACKGROUND:

Per the requirements of the conditions of approval and mitigation monitoring program for the Buena Vista Wind Energy Project (County File #LP022005), avian and bat mortality monitoring was required for three years after operation of the windfarm commenced. The original contract was approved in October of 2007, but actual avian and bat mortality monitoring did not start until February 2008. Avian and bat mortality monitoring for Buena Vista has been completed, but additional time is needed in order for the Buena Vista Technical Advisory Committee (TAC) to approve and finalize the Buena Vista Avian and Bat Mortality Project Final Report.

CONSEQUENCE OF NEGATIVE ACTION:

The Avian and Bat Mortality project final report will not be done prior to expiration of the contract.
