RECOMMENDATION(S):

APPROVE the allocation of an additional $220,000 (total of $530,000) in Fiscal Years 2006/07, 2007/08 and 2008/09 Housing Opportunities for Persons with AIDS (HOPWA) funds for the Riley Court Apartment project, Concord.

FISCAL IMPACT:

No General Funds impact. The funds are provided to Contra Costa County from the Department of Housing and Urban Development (HUD) through the City of Oakland, as administering agent.

Housing Opportunities for Persons with HIV/AIDS (HOPWA) Program – 14.241  

BACKGROUND:

On December 7, 2010, the Board of Supervisors approved $310,000 in HOPWA funds to allocate to the Riley Court project. Staff is now recommending the Board approve the allocation of $220,000 in HOPWA funds for a total of $530,000 in HOPWA funds.   
  
The National Affordable Housing Act (Public Law 101-625, approved November 28, 1990) authorizes the Housing Opportunities for Persons with AIDS Program (HOPWA) to provide states and localities with resources to devise long-term comprehensive strategies for meeting the housing needs of persons with HIV/AIDS and related diseases.  
  
The City of Oakland distributes the funds to Contra Costa County on a formula basis. The County administers these funds on behalf of the County as administering agent on behalf of the Urban County and other Contra Costa entitlement jurisdictions (the cities of Antioch, Concord, Pittsburg, Richmond, and Walnut Creek). These funds may be used for acquisition, rehabilitation and new construction of housing; supportive services; housing information services; and certain other housing related activities for low-income persons with HIV/AIDS.   
  
The purpose of the Riley Court Apartment project is to improve 48 units of rental housing affordable to and occupied by lower income families, including those with HIV/AIDS in Concord and Central County. Resources for Community Development (RCD) is the developer of the project, which involves the rehabilitation of 41-one bedroom units and 7-two bedroom units. Five of the one bedroom units will be designated for persons living with HIV/AIDS. In accordance with HOPWA regulations, RCD will contract with the HSD Homeless Program to be the lead service agency and direct provider of services to residents of Riley Court. RCD acquired the property in 1997 with financing from the Contra Costa County HOME program, the City of Concord, and other sources. The City of Concord is supportive of this project; City staff plans to take $300,000 funding recommendation to the City Council in January 2011.   
  
Staff will return to the Board at a later date with legal documents for HOPWA and CEQA approval.  

CONSEQUENCE OF NEGATIVE ACTION:

The project financing would no longer be feasible, therefore an opportunity for achieving affordable housing opportunities will have been lost.
