RECOMMENDATION(S):

APPROVE and AUTHORIZE the County Risk Manager to execute contracts with selected legal firms for defense of the County in workers' compensation, medical malpractice and civil rights claims for a period of one year effective January 1, 2011 through December 31, 2011 in accordance with a specified fee schedule for the following: Craddick, Candland & Conti; Edrington, Shirmer & Murphy; John F. Martin; Hanna, Brophy, McLean, et.al.; Thomas, Cartier, Lyding & Gaus; Mullen & Filippi; McNamara, Dodge, Ney, Beatty, et.al.; Gordon, Watrous, Ryan, Langley, Bruno & Paltenghi (GHAD and Legal Services); D’Andre, Peterson, Bobas, et.al.; Corren and McClellan.

FISCAL IMPACT:

Legal costs are funded through the Workers' Compensation, Liability and Medical Malpractice Internal Trust Funds.

BACKGROUND:

Legal firms were selected for their experience and expertise in particular areas of legal defense. Risk Management assigns cases to the various firms. The following legal firms selected for defense of claims agree to one-year contracts from January 1, 2011 to December 31, 2011: Craddick, Candland & Conti; Edrington, Shirmer & Murphy; John F. Martin; Hanna, Brophy, McLean, et.al.; Thomas, Cartier, Lyding & Gaus; Mullen & Filippi; McNamara, Dodge, Ney, Beatty, Etc; Gordon, Watrous, Ryan, Langley, Bruno & Paltenghi (GHAD and Legal Services); D’Andre, Peterson, Bobas, et.al.; and Corren and McClellan.

CONSEQUENCE OF NEGATIVE ACTION:

Risk Management will not be able to utilize the assistance and expertise of outside legal counsel.
