RECOMMENDATION(S):

APPROVE and AUTHORIZE the Conservation and Development Director, or designee, to execute a contract in an amount of $2,150,000 with Mirant Marsh Landing, LLC, for the period beginning January 11, 2011 and continuing until terminated based on the terms of the contract, to provide design review, plan check and construction inspection services for the Marsh Landing Generating Station.  
  

FISCAL IMPACT:

All County costs incurred related to this contract will be fully recovered through fees charged to the power plant operator, Mirant Marsh Landing, LLC.

BACKGROUND:

The Marsh Landing Generating Station is a thermal electric power plant under the jurisdiction of the California Energy Commission (CEC). The CEC approved the project on August 25, 2010.   
  
The CEC has requested that the Department of Conservation and Development (DCD), Building Inspection Division, serve as Chief Building Official for the Marsh Landing Generating Station project. The County Building Inspection Division has extensive prior experience providing building inspection services for power plant projects, and has served in the capacity of Chief Building Official for previous power plant projects on behalf of the CEC.  
  
On May 25, 2010, the Board of Supervisors authorized DCD to execute a Memorandum of Understanding (MOU) with the CEC that authorizes DCD to provide building inspection services for this project. The MOU directs DCD to enter into a contract with the project operator, Mirant, so that DCD can recover its costs for providing services. The proposed contract fulfills the requirements of the MOU.

CONSEQUENCE OF NEGATIVE ACTION:

If the proposed contract is not approved, DCD will not be able to provide building inspection services for the Marsh Landing Generating Station project.
