RECOMMENDATION(S):

Approve and authorize the Health Services Director, or his designee (Patricia Tanquary), to execute, on behalf of the County, Contract Amendment Agreement #27-579-1 with Bay Area Therapeutic Radiology and Oncology Associates Medical Group, Inc., a corporation, effective January 1, 2010, to amend Contract #27-579, to delete the indemnification clause, with no change in the Payment Limit of $95,000 and no change in the original term of April 1, 2009 through March 31, 2011.

FISCAL IMPACT:

This Contract is funded 100% by Contra Costa Health Plan Member Premiums.

BACKGROUND:

In July 2009, the County Administrator approved and the Purchasing Services Manager executed Contract #27-579 with Bay Area Therapeutic Radiology and Oncology Associates Medical Group, Inc. for the period from April 1, 2009 through March 31, 2011, for the provision of Radiology and Oncology services for Contra Costa Health Plan members.

Approval of Contract Amendment Agreement #27-579-1 will modify the Contract to reflect the intent of the parties, which is to delete General Conditions, Paragraph 18. (Indemnification), and allow the Contractor to continue to provide Radiology and Oncology services, through March 31, 2011. This change in indemnification has been reviewed by both the Risk Manager and County Counsel.
