RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a novation contract with Nomad Ecology Consulting, effective January 1, 2009, in an amount not to exceed $150,000 to provide on-call environmental consulting services for various projects countywide.

FISCAL IMPACT:

There is no impact to the County General Fund. This project is funded by 48% Flood Control & Water Conservation District, 48% Local Road, 4% Airport Project Funds.

BACKGROUND:

Effective January 1, 2009, on behalf of the Contra Costa County (County), the Public Works Department (Department) entered into a three-year Consulting Services Agreement (CSA) contract with Nomad Ecology Consulting (Nomad) in an amount not to exceed $50,000 for on-call environmental consulting services for various projects throughout the County.   
  


BACKGROUND: (CONT'D)
Due to contracting changes, the CSA contract is no longer appropriate for this type of work. Therefore, a novation contract was implemented onto the County’s Standard Long Form contract to replace the original CSA and subsequent amendments. This novation contract includes a payment limit increase of $100,000 to a new payment limit of $150,000, and additional provisions that apply to projects funded by the United States Department of Transportation.   
  
The attached novation contract, if approved, will include these additional terms and will make the previous January 1, 2009, CSA contract void.   
  
Nomad is certified as a Small Business Enterprise (SBE). The Department has determined that Nomad is qualified to conduct the necessary work.   

CONSEQUENCE OF NEGATIVE ACTION:

Without Board approval, environmental assessments will not be completed in a timely manner and the necessary California Environmental Quality Act (CEQA), National Environmental Policy Act (NEPA), and East Contra Costa County Habitat Conservation Plan (HCP) clearances will not be obtained, which may delay the design and construction of various projects and jeopardize funding.
