RECOMMENDATION(S):

APPROVE Appropriation Adjustment No. 5047 authorizing revenue in the Sheriff's Office (0255) in the amount of $1,038,741 from restricted civil revenues and appropriating it to fund the Sheriff's Civil Unit for fiscal year 2009/10.

FISCAL IMPACT:

This action increases revenue and appropriations by $1,038,741. There is no change in net county cost.

BACKGROUND:

The Civil Unit of the Office of the Sheriff carries out legal mandates of the Government Code and Code of Civil Procedure to serve all processes of the courts, which are delivered to the Sheriff. These include but are not limited to: collecting money from wage garnishments and bank levies, performing evictions, serving restraining orders and civil bench warrants, and enforcing civil judgments.  
  


BACKGROUND: (CONT'D)
AB1109 and AB709 allow for assessment of civil process and civil processing fees. Civil Process Fees are required to be charged when the Office of the Sheriff enforces civil actions or levies on property or assets to satisfy monetary judgments. Additionally, a Civil Processing Fee of $10.00 is collected from the judgment debtor on each disbursement of money paid under a writ of Attachment, Execution, Possession or Sale. Both of these fees are restricted for use by the Civil Unit of the Office of the Sheriff for the vehicle and automation programs.
