RECOMMENDATION(S):

ADOPT Resolution No. 2009/177 accepting completion of improvements for Minor Subdivision 90-00143, for project being developed by Todd Fujinaga, as recommended by the Public Works Director, Walnut Creek area. (District III)

FISCAL IMPACT:

None.

BACKGROUND:

The developer has completed the private road improvements per the Subdivision Agreement, and in accordance with Title 9 of the County Ordinance Code.

CONSEQUENCE OF NEGATIVE ACTION:

The completion of the private road improvements will not be accepted, the developer will not receive a refund of their performance/maintenance cash bond, the Subdivision Agreement will not be exonerated and the payment claim period will not begin.
